📋 Terms & Conditions of Sale and Use — Luxury Market

PREAMBLE
These Terms and Conditions of Sale and Use (hereinafter "T&Cs") govern, without restriction or reservation, all sales concluded and services provided by Luxury Market (hereinafter "the Seller") through the website www.luxury-market.fr (hereinafter "the Website").
Any order placed on the Website implies the full, entire and unreserved acceptance of these T&Cs by the customer (hereinafter "the Customer"), who acknowledges having read them prior to their order.
The applicable T&Cs are those in force on the date of the order. The Seller reserves the right to modify them at any time; the modified T&Cs shall apply to orders placed after their publication online.

ARTICLE 2 — DEFINITIONS
- "Customer": any natural person of legal age and capacity, acting for purposes that do not fall within the scope of their commercial, industrial, craft or liberal activity (consumer within the meaning of the preliminary article of the French Consumer Code).
- "Product": any item offered for sale on the Website.
- "Order": any purchase request for Product(s) validated by the Customer on the Website.
- "Contract": the whole formed by these T&Cs and the Order confirmation.
ARTICLE 3 — PURPOSE
The purpose of these T&Cs is to define:
- The terms of distance selling of the Products offered on the Website;
- The respective rights and obligations of the parties;
- The conditions of use of the Website.
ARTICLE 4 — PRODUCTS
4.1. Description
The Products offered for sale are those appearing on the Website on the day of consultation by the Customer, within the limits of available stock. The Seller takes the utmost care in the presentation and description of its Products (photographs, descriptions, dimensions, materials, composition).
Photographs and illustrations are provided for information purposes only and do not contractually bind the Seller in the event of slight variations (color shades on screen, presentation).
4.2. Availability
Product offers are valid as long as they are visible on the Website, within the limits of available stock. In the event of unavailability of a Product after the Order has been placed, the Seller will inform the Customer by e-mail as soon as possible and will proceed with a full refund of the sums paid within a maximum of 14 days.
4.3. Authenticity
Luxury Market undertakes to market only authentic products. Each item is carefully inspected before shipment. [Where applicable: "and delivered with a certificate of authenticity"].
ARTICLE 5 — PRICES
5.1. Currency and VAT
The prices of the Products are indicated on the Website in euros (€), all taxes included (VAT incl.), excluding shipping costs.
5.2. Price changes
The Seller reserves the right to modify its prices at any time. However, Products will be invoiced on the basis of the rates in force at the time of Order validation.
5.3. Shipping fees
Shipping fees are indicated to the Customer before Order validation and invoiced in addition to the price of the Products.
ARTICLE 6 — ORDER
6.1. Ordering process
The Customer places their Order online according to the following steps:
- Product selection and addition to cart;
- Verification of cart contents (Products, quantities, prices);
- Identification (login or account creation) or guest checkout;
- Choice of shipping method and address entry;
- Choice of payment method;
- Order summary and express acceptance of the T&Cs;
- Final validation by clicking the "Order with obligation to pay" button (in accordance with Article L.221-14 of the French Consumer Code);
- Secure payment;
- Receipt of an Order confirmation e-mail summarizing the Order.
6.2. Formation of the contract
The Contract is formed when the Seller sends the Customer the Order confirmation by e-mail. The Seller reserves the right to refuse or cancel any Order from a Customer with whom there is a prior dispute, or in the event of suspected fraud.
6.3. Archiving
In accordance with Article L.213-1 of the French Consumer Code, for Orders exceeding €120, the Seller archives the Order for 10 years and guarantees the Customer access upon simple request.
ARTICLE 7 — PAYMENT
7.1. Payment methods
Payment is made online, at the time of the Order, by:
- 💳 Credit card (Visa, Mastercard, American Express)

- 🍎 Apple Pay / Google Pay
- 💸 Klarna / Alma (payment in 3 or 4 installments free of charge, subject to acceptance)
- 🏦 Bank transfer (on request, for Orders exceeding €3,800)
7.2. Payment security
Transactions are secured by the provider [Stripe / PayPal / other], PCI-DSS Level 1 certified, with SSL/TLS encryption and strong 3D-Secure 2.0 authentication (PSD2). No banking data is stored by the Seller.
7.3. Payment default
Any Order shall be deemed not concluded in the event of refusal of payment authorization. In the event of non-payment, the Seller reserves the right to suspend or cancel the Order, and to invoice late payment penalties at the legal rate in force (Art. L.441-10 French Commercial Code).
ARTICLE 8 — DELIVERY
8.1. Delivery zone
Products are delivered to Mainland France, French Overseas Territories, European Union, Switzerland, United Kingdom, USA, Africa, etc.
8.2. Delivery times
Indicative delivery times are:
- 🇫🇷 Mainland France: 7 to 15 business days
- 🇪🇺 European Union: 7 to 15 business days
- 🌍 Rest of the world: 7 to 15 business days
Times start from payment validation.
In accordance with Article L.216-2 of the French Consumer Code, in the event that the indicated delivery date is exceeded, the Customer may, after having instructed the Seller to deliver within a reasonable additional period, terminate the Contract by registered letter with acknowledgment of receipt or in writing on a durable medium, if delivery does not take place within this new period.
8.3. Carriers
Deliveries are provided by: Colissimo / Chronopost / Mondial Relay / DHL Express / others.
8.4. Receipt & reservations
Upon receipt, the Customer is required to check the condition of the parcel and its conformity in the presence of the carrier. In the event of an anomaly (damaged, opened, wet parcel, etc.), the Customer must make precise and detailed reservations on the delivery note and refuse the parcel if necessary, then inform the Seller within 3 business days at contact@luxury-market.fr.
8.5. Transfer of risk
In accordance with Article L.216-4 of the French Consumer Code, the transfer of risk takes place at the moment when the Customer (or a third party designated by them) physically takes possession of the Product.
ARTICLE 9 — RIGHT OF WITHDRAWAL
9.1. Time limit
In accordance with Article L.221-18 of the French Consumer Code, and with European Directive (EU) 2023/2673 in force since June 19, 2026, the Customer has a period of 14 calendar days from receipt of the Order to exercise their right of withdrawal, without justification or penalty.
9.2. Methods of exercise
The Customer may exercise their right:

- 📧 By e-mail to contact@luxury-market.fr;
- 📮 By post, using the standard withdrawal form available for PDF download.
An acknowledgment of receipt on a durable medium will be sent without delay.
9.3. Effects
The Customer has 14 days from notification of their withdrawal to return the Product, in its original condition, unworn, unwashed, with tags attached and in its original packaging.
Return shipping costs are the responsibility of the Customer, except in the case of a non-conforming or defective product.
The Seller will proceed with the full refund (including initial shipping fees, excluding additional fees related to a more expensive shipping method chosen by the Customer) at the latest 14 days after notification of the withdrawal, and at the earliest upon receipt of the Product or proof of shipment (whichever comes first).
9.4. Exceptions
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply, in particular, to:
- Personalized or made-to-order Products;
- Unsealed Products that cannot be returned for hygiene reasons (underwear, swimwear without hygienic protection, earrings, etc.);
- Final Sale Products, except for manufacturing defect or non-conformity.

ARTICLE 10 — LEGAL GUARANTEES
Regardless of the right of withdrawal, the Customer benefits from the following legal guarantees:
10.1. Legal guarantee of conformity (Art. L.217-3 to L.217-17 French Consumer Code)
The Customer has a period of 2 years from delivery of the Product to take action. They may choose between repair or replacement of the Product, subject to the cost conditions provided for in Article L.217-12. They are exempt from providing proof of the existence of the defect of conformity during the 24 months following delivery of the Product.
10.2. Guarantee against hidden defects (Art. 1641 to 1649 French Civil Code)
The Customer may take action within a period of 2 years from the discovery of the defect. They may choose between rescission of the sale or a price reduction (Art. 1644 French Civil Code).

ARTICLE 11 — CLAIMS & MEDIATION
11.1. Customer service
For any claim, the Customer may contact customer service: 📧 contact@luxury-market.fr — Response within 48 business hours.
11.2. Consumer mediation
In accordance with Articles L.611-1 et seq. of the French Consumer Code, in the event of a dispute not resolved amicably, the Customer may refer the matter free of charge to the mediator:

ARTICLE 12 — LIABILITY
The Seller cannot be held liable for non-performance of the Contract in the event of:
- Force majeure within the meaning of Article 1218 of the French Civil Code;
- Act of the Customer (incorrect address, absence at delivery, etc.);
- Unforeseeable and insurmountable act of a third party unrelated to the Contract.
The Seller's liability shall not, in any event, exceed the VAT-inclusive amount of the Order giving rise to the dispute.
ARTICLE 13 — INTELLECTUAL PROPERTY
All elements of the Website (texts, images, logos, trademarks, database, source code, etc.) are protected by intellectual property rights and are the exclusive property of the Seller or its partners.
Any reproduction, representation, modification, publication, adaptation, in whole or in part, is strictly prohibited without prior written authorization, under penalty of constituting infringement sanctioned by Articles L.335-2 et seq. of the French Intellectual Property Code.
The "Luxury Market" trademark is [a trademark registered with INPI under No. 054541515 / a trade name].
ARTICLE 14 — PERSONAL DATA
Personal data collected via the Website is processed in accordance with the General Data Protection Regulation (GDPR - EU 2016/679) and the amended French Data Protection Act.

ARTICLE 15 — COOKIES
The Website uses cookies to improve the user experience, measure audience and offer personalized content. The Customer may at any time manage their preferences via the cookie management banner. See the dedicated [Cookie Policy].
ARTICLE 16 — ENTIRE AGREEMENT
These T&Cs express the entire obligations of the parties. No general or specific condition communicated by the Customer may be integrated into these T&Cs.
If any of the stipulations of these T&Cs were to be declared null or inapplicable, the other stipulations would retain their full force and effect.
ARTICLE 17 — APPLICABLE LAW & JURISDICTION
These T&Cs are subject to French law.
In the event of a dispute, and failing an amicable settlement, the parties undertake to have recourse to mediation as a priority (see Article 11). Failing this, the dispute will be brought before the competent French courts, in accordance with the rules of common law, subject to the protective provisions of consumer law allowing the latter to refer the matter to the court of their place of residence (Art. R.631-3 French Consumer Code).
